These Town Consumer Terms of Service (the Consumer Terms) govern your access to and use of the Town mobile application, website, digital loyalty features, rewards features, offers, content and related consumer-facing services made available by Town Platforms Limited (company number 16585137) whose registered office is at 71-75 Shelton Street, London, England, WC2H 9JQ (Town, we, us or our).
By creating an account, accessing, downloading or using Town as a consumer user, you agree to be bound by these Consumer Terms. If you do not agree, you must not use the Services.
1. Who these Consumer Terms apply to
These Consumer Terms apply to individuals who use Town as personal, non-business users to discover participating businesses, access offers, participate in rewards programmes, collect or redeem Town Cash, access digital loyalty cards, referral incentives, content and related consumer features (together, the Consumer Services).
If you are using Town on behalf of a business, or as a merchant, partner, advertiser or other commercial user, the Town Business Platform Terms will apply instead of these Consumer Terms.
2. Eligibility and account registration
You must be at least 16 years old to create an account or use the Consumer Services.
You must provide accurate, complete and up-to-date information when you register and keep your account details updated.
You are responsible for all activity carried out through your account, for maintaining the confidentiality of your login credentials, and for ensuring that your device and account are kept secure.
We may refuse to accept registrations, require identity or eligibility checks, reclaim usernames, or suspend or terminate accounts at our discretion.
3. Nature of the Consumer Services
Town provides a digital platform that helps users discover participating businesses, receive offers, collect and redeem rewards, and use digital loyalty and referral features.
Town is not the seller, reseller or supplier of any goods or services offered by participating businesses. Any purchase you make from a participating business is a contract between you and that business alone.
Town does not process consumer payments for merchant goods or services. Participating businesses are solely responsible for their own pricing, stock, fulfilment, service delivery, legal compliance, consumer rights compliance, offer fulfilment and loyalty fulfilment.
4. Town Cash, rewards, offers and loyalty features
4.1 General nature of Town Cash and rewards
Town Cash, points, referral incentives, digital loyalty stamps, benefits, discounts, offers and similar rewards made available through the Consumer Services (together, Rewards) are promotional features only.
Rewards:
4.2 Earning Rewards
Rewards may be granted based on qualifying actions such as purchases, scans, check-ins, referrals, campaign participation, profile completion, promotional activities or other engagement criteria determined by Town or participating businesses.
Although Rewards may sometimes be calculated by reference to the cash value of a transaction, that does not give the Reward any cash value or monetary status.
We may delay, withhold, reverse, adjust or cancel Rewards where we reasonably believe that:
4.3 Redeeming Rewards
Rewards may only be redeemed in the manner, location, timeframe and quantity specified by Town or the participating business.
Redemption is always subject to availability, merchant participation, technical functionality, compliance checks and any applicable offer conditions.
A participating business may refuse redemption where you fail to meet the applicable conditions, where stock or allocation is unavailable, where fraud or misuse is suspected, or where the relevant promotion has ended or been withdrawn.
4.4 Expiry and changes
Unless a shorter period is expressly stated for a particular Reward, any Reward validly earned by a consumer user will remain capable of redemption for up to 24 months from the date it is granted, unless it is redeemed earlier, reversed or cancelled in accordance with these Consumer Terms.
After that 24-month period, the Reward will expire automatically and may be removed from the user’s account.
We may still add to, remove, suspend, replace, cap, modify or discontinue any Reward programme, redemption value, tier, mechanic, eligibility rule, partner, merchant, category or promotional structure going forward, but, except where a Reward is reversed or cancelled in accordance with these Consumer Terms, such changes will not usually remove a Reward already validly earned before the end of its applicable 24-month validity period.
We may reverse, adjust or cancel Rewards before redemption where we reasonably believe that:
4.5 No guarantee of availability or value
We do not guarantee that any specific Reward, business, discount, item, redemption opportunity, offer tier or digital loyalty programme will always be available, honoured, continue unchanged, or provide any particular level of value.
5. Merchant offers and merchant responsibility
Participating businesses are solely responsible for:
Town is not responsible for and does not control merchant stock levels, service quality, food safety, fulfilment, delays, cancellations, pricing errors, advertising accuracy, redemption refusals, venue access, conduct, or compliance.
Any dispute concerning merchant goods, services, offer fulfilment, digital loyalty fulfilment or redemption should be raised directly with the relevant business in the first instance.
6. Referrals and promotions
We may operate referral schemes, welcome promotions, bonus campaigns, seasonal promotions or similar programmes.
Unless expressly stated otherwise, we may determine or change the rules, eligibility criteria, limits, anti-abuse controls, timing, amounts and withdrawal or cancellation of those programmes at our discretion.
We may withhold or reverse promotional Rewards if we suspect self-referrals, duplicate accounts, incentivised abuse, misrepresentation, spam, manipulated activity or any attempt to game the platform.
7. Your obligations and acceptable use
You must not:
8. Geolocation, device permissions and app functionality
Certain features may depend on location services, device permissions, notifications, network connectivity, compatible hardware, operating systems or third-party services.
If you enable such permissions, you agree that Town may process location, device and related technical data in accordance with our Privacy Policy.
We do not guarantee uninterrupted access, perfect accuracy of location-dependent features, or compatibility with every device or operating system.
9. Intellectual property
All intellectual property rights in the Consumer Services, including the app, software, platform design, branding, data structures, features, compilations, text, graphics and underlying technology, are owned by or licensed to Town.
Subject to your compliance with these Consumer Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Consumer Services for personal, non-commercial use.
You do not acquire any ownership rights in the Consumer Services.
10. Privacy
Our collection and use of personal data is described in our Privacy Policy, which forms part of your relationship with us.
The Privacy Policy explains, among other things, what personal data we collect, how we use it, when we share it, how long we retain it, and your rights in relation to your personal data.
11. Suspension, restriction and termination
We may, at any time and without liability, suspend, restrict, disable or terminate your account or access to any part of the Consumer Services immediately where we consider it reasonably necessary, including where:
If your account is suspended or terminated, some or all accumulated Rewards may be forfeited, cancelled or become inaccessible, subject always to clause 4.4 and any mandatory rights you may have under applicable law.
Sections that by their nature are intended to survive termination will continue in force after termination.
12. Changes to the Consumer Services and these Consumer Terms
We may update, modify, suspend or discontinue any aspect of the Consumer Services at any time.
We may also amend these Consumer Terms from time to time. The updated version will become effective when posted, or on any later date specified by us. By continuing to use the Consumer Services after changes take effect, you agree to the revised Consumer Terms.
13. Disclaimers
To the maximum extent permitted by law, the Consumer Services are provided on an “as is” and “as available” basis.
We do not warrant or guarantee that the Consumer Services will be uninterrupted, secure, error-free, always available, free from bugs, compatible with all devices, or that any content, listing, Reward, merchant offer or platform feature will be accurate, complete or current.
Any merchant content, offer details, stock indications, wait times, descriptions or promotional claims may be inaccurate, incomplete or outdated, and Town is not responsible for that.
Nothing in these Consumer Terms excludes any rights you may have under mandatory consumer law that cannot legally be excluded.
14. Limitation of liability
Nothing in these Consumer Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
Subject to the paragraph above, Town shall not be liable for any:
To the extent permitted by law, Town’s total aggregate liability to you arising out of or in connection with the Consumer Services or these Consumer Terms shall not exceed £100.
15. Complaints
If you have a complaint about Town, you may contact us at info@jointown.co.uk.
If your complaint relates to a participating business’s goods, services, staff, stock, pricing, fulfilment or conduct, you should contact that business directly first.
16. General
If any provision of these Consumer Terms is held to be invalid, illegal or unenforceable, the remaining provisions will continue in full force and effect.
Our failure to enforce any provision shall not constitute a waiver.
You may not assign or transfer your rights or obligations under these Consumer Terms. We may assign or transfer our rights and obligations under these Consumer Terms at any time.
These Consumer Terms constitute the entire agreement between you and Town in relation to the Consumer Services.
17. Governing law and jurisdiction
These Consumer Terms and any non-contractual disputes or claims arising out of or in connection with them are governed by the law of England and Wales.
If you are a consumer resident in the United Kingdom, you may bring proceedings in the courts of the part of the UK in which you live. If you live in England or Wales, the courts of England and Wales will have non-exclusive jurisdiction.
